These Terms of Service ("Terms") govern your access to and use of the website operated by Coldapollo at coldapollo.space (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

The Site and its content including text, graphics, logos, and software are owned by Coldapollo or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from Site content without our prior written permission, except for personal, non-commercial viewing of publicly available pages.

6. User submissions

If you submit information through the waitlist, contact forms, or email, you grant us a non-exclusive license to use that information to operate the Site and respond to you, as described in our Privacy Policy. You represent that you have the right to provide the information you submit and that it is accurate.

7. Third-party services

The Site may rely on third-party hosting, CDN, email, analytics, or payment providers. Your use of third-party services may be subject to their own terms. We are not responsible for third-party services we do not control.

8. Billing and refunds

If you purchase products or services from us, prices, taxes, and payment terms will be presented at checkout. Refunds are governed by our Refund Policy. Failure to pay may result in suspension of related services.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Coldapollo AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Nothing in these Terms excludes liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Coldapollo and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third-party rights.

12. Suspension and termination

We may suspend or terminate access to the Site at any time, with or without notice, for any reason including maintenance, security, or violation of these Terms. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive termination.

13. Changes

We may modify these Terms from time to time. The "Effective date" will be updated when changes take effect. Continued use of the Site after changes constitutes acceptance. If you do not agree to the revised Terms, stop using the Site.

14. Governing law

These Terms are governed by the laws applicable in the jurisdiction where Coldapollo operates its principal place of business, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence apply.
